Theft of Firearm and Assault 4th Degree - Dismissed!
Our client was charged with Theft of a Firearm, KRS 514.030 and Assault 4th Degree, Domestic Violence. Theft of a Firearm is a Class D felony carrying a penalty of one (1) to five (5) years in prison. Assault 4th Degree, Domestic Violence, is a Class A misdemeanor carrying a penalty of up to twelve (12) months in jail and a $500 fine.
At the time these charges were brought against our client, he was on parole for a previous conviction. It was extremely important that he was ultimately found not guilty of the new charges. Any new conviction would violate his parole and he would have to serve the remaining portion of his prior sentence in prison.
With the stakes high and his freedom on the line, he chose to retain Abe Mashni and the criminal defense team at Baldani, Rowland & Richardson. After a thorough investigation of the allegations, interviews with witnesses, Abe was able to provide new information to the prosecutor. Based on the new information, the Commonwealth agreed to dismiss the Theft of a Firearm felony charge. This was undoubtedly a huge victory, but the work was not done.
After another round of negotiations with the prosecutor, our client agreed to attend 28 domestic violence/anger management classes in exchange for a dismissal of the Assault 4th, domestic violence. Since that time, he's completed the classes, his case has been dismissed, and he walked out of the courtroom for the last time a free man.
